John Erwin vs. Samuel Erwin--Rockingham, Slander. John Erwin deposeth, 15th August, 1793: In year 1776 plaintiff (Samuel Erwin) came to defendant's father's house and told defendant that himself and his
brothers, Benjamin, Andrew, John and William Erwin, had come to agreement to value the land their father formerly possessed at £300, and that Samuel Erwin and his brothers, Benjamin and Andrew, had purchased the shares belonging to John and William Erwin. Deposition of Thomas Woodall, 25th March, 1797: John Erwin was a man of good character, but some persons spoke badly of him. Thomas is about to remove to Kentucky.

JUDGMENTS.
Lowry vs. Erwin--Causes ended. Old number 444 N. S., 165. Bill -- Jane Lowry obtained judgment vs. Andrew Erwin. Andrew conveyed personality to his brother Edward; this conveyance attached; filed 29th September, 1804, in High Court of Chancery. Answer of Andrew: In 1798 he borrowed large sum from Edward; gave bond with his son William as witness, and also Thomas Massey, who enlisted with Capt. Gibson. Sworn to 18th February, 1805. Summons, dated 20th May, 1810. Sheriff of Augusta. Against Edward, Jane, John, James, Nancy, Andrew Erwin and Daniel Fane, and Mary, his wife, to answer supplemental bill by Jane Lowry. Returned executed on Fane and wife; others no inhabitants. Supplemental bill--Andrew Erwin has lately died intestate, leaving Jane, his widow, and others (except Edward), his children and heirs. Andrew owned land, partly a tract bought from his brother Benjamin. Summons on supplemental bill--24th May, 1804, to Sheriff, Rockingham County, against Andrew and Edward Erwin. Executed same 13th September, 1804, to Sheriff, Augusta, vs. Edward Erwin; executed. Deposition of Samuel Erwin, brother of Edward and Andrew--The Lowrys moved away, to Pattonsburg (?).

Erwin vs. Baxter--Causes ended--O. S., 444; N. S., 165. Benjamin Erwin in 1811, 25th December, purchased from his brother John a tract on Little Back Creek in Bath. Shortly afterwards John died intestate, unmarried; John bought from John Baxter; Benj. sues for title.

William's parents are Benjamin Ervine born: abt 1785 in Rockingham, VA. Died: 1812-1819, Married: 28 Apr 1806 to Jane Curry born: 1785. she daughter of Benjamin Curry born in 1750. Benjamin Ervine was the son of Benjamin Ervine born: 1745 in Augusta, VA. Died: 1810 in Rockinham, VA. married: 1775 to Mary "Molly" Curry born: 1750/58 in Augusta, VA. Died: 1805 she daughter of Dr. Robert Curry Born: 10 Nov 1717 in Isle of Man died: 29 Dec 1803 in Augusta, VA. and Ann Curry born: 25 Sep 1727 in Ulster Ireland died: 15 May 1819 (Believed to be a cousin since same last name, but not sure). Benjamin Ervine is the son of John Ervine Born: abt 1706 in Ireland died: 15 Feb 1762 in Augusta, VA. married 1724 to Jean William born:1707 in Ireland. John's parents are Edward Ervine born: 1669 in Ulster, Ireland died: 1763 in Augusta, VA. married abt 1705 in Ireland to Frances Francis (not sure of her name) born: 1685 in Ireland. (Note that the Curry line is confusing as there are several Mary's and Molly's who are daughters of Robert's)

Seeking parents of Benjamin Ervine, who settled Highland County, Va, c.a. 1800. He supposedly mar. Mary ? (b. in Ireland c., 1750). My ancestor is his dau., Frances, b. 1797, who mar. William E. Ervine, Sr. (nephew of Benjamin) in 1816. William came to Highland from Rockingham County.

I believe that there were five Ervin/Ervine brothers who settled the Augusta region in the early 1700's: Robert, Francis, Edward, Benjamin and John. I am unable to determine whether or not my Benjamin is the same as the early settler.

I would like to find the parents of my ancestor William, and also the parents and wife of Benjamin.

Any help is appreciated.
