Assault Fatal To Greenbrier Lady

LEWISBURG, April 30 - Mrs. Maxie Jane Kelly, of Muddy Creek Mountain, widow of the late Sam Kelly, died at a Ronceverte hospital this afternoon at 1:45 of a compound skull fracture.

The woman's injury allegedly was the result of an attack made on her last Wednesday night between 8:30 and 9 o'clock by Fred Lewis and his sister, Edith Young, Negroes, of Leslie.

Mrs. Kelly was taken to the hospital last Wednesday night in an unconscious condition. She never regained consciousness to give an account of the assault made on her.

Her daughter, Mrs. Margaret Kelly, who made her home with her mother, went to the office of Prosecuting Attorney Nickell Kramer here the next morning and swore out a warrant for Lewis and his sister for an assault and battery charge. She told the prosecuting attorney that the Negroes has come to the home Wednesday night. Mrs. Young, she said, knocked at the door and asked for some liniment, and that while her mother was standing in the doorway Lewis struck her over the head.

The pair was arrested and placed in jail, and when Mrs. Kelly's condition became worse her daughter obtained warrants against the pair for assault with intent to kill. They are being held in the county jail to await grand jury action.

Prosecuting Attorney Kramer and State Troopers Shirley Clinton and W. M. Shanklin are investigating the case to determine if the alleged assault resulted in Mrs. Kelly's death.

She was born at Lewisburg on September 22, 1894.

Surviving are two daughters, Margaret and Cora, at home; two sons, Colie, of Muddy Creek Mountain, and Sam, of White Sulphur Springs; five brothers, John Hunter, Lewisburg; George and Hubert, Dawson; Renick, Goshen, Va., and Charles, White Sulphur Springs; three sisters, Mrs. Lilly Walton, White Sulphur Springs; Mrs. Harvey Arbaugh, Lewisburg; and Mrs. Lula Jones, Lawton.

Funeral arrangements were incomplete tonight.


Maxie married Samuel Sanders KELLEY Sr., son of Joseph H. KELLEY and Nannie Virginia E. JIANNINEY, on 29 Dec 1912 in Greenbrier Co., WV.22 (Samuel Sanders KELLEY Sr. was born on 30 Nov 1883 in Greenbrier Co., WV,16,24,25 died on 6 Aug 1926 in Muddy Creek Mountain, Greenbrier Co., WV 25 and was buried on 7 Aug 1926 in Kelly Cemetery, Fort Spring, Greenbrier Co., WV 25.). The cause of his death was shot himself with pistol.
