That the said John Hayslette, the devisee of his father, the said Ezekiel, pretending to claim the said tract of 72 acres, under his fathers said will, took possession thereof, at his fathers death & held it until his own death, which occurred in July 1870, when he died in testate, leaving Mary, his widow, heir surviving, & Jas. Dorman Hayslette, Virginia Hayslette & Wm. Hayslette, his heirs at law, all infants under 21.

That the said Ezekiel Hayslette & his wife continued in the joint possession thereof until his death about 10 years before, which occurred on the day of 1867, after which, it continued in the possession of his son John as his devisee until her death, which occurred in Nov 1870. The said Ezekiel Hayslette separated from his wife seventeen years before his death & remained separated until his death.
